Foreclosures

Foreclosure is the legal process by which a mortgage lender, or other lien holder, obtains a clear title to real estate property which secured the mortgage loan or is an available asset against which a lien holder can seek to satisfy an outstanding judgment. There can be liens, and resulting court judgments, for items such as overdue taxes, unpaid contractors' bills or overdue homeowners' association dues or assessments.

The mortgage lender or lien holder seeks to “foreclose” on a property so they can sell the property and keep the proceeds to pay off the mortgage or other debt they are owed ,in addition to recouping their legal costs for the foreclosure process. In the case of a mortgage or loan agreement that contained a “recourse clause”, if the sale of the real estate does not bring enough to pay the existing balance of the mortgage/loan principal and fees, the mortgage holder/lender can file a claim for a “deficiency judgment”.
